Alcohol made the 16-year-old girl spend a bad night. She was practically unconscious and was chased, stripped of her clothes, penetrated and recorded by the aggressor, who would then send the video to all her friends showing the aggression.

The video reached the hands of the judicial bodies that captured the young man for the crime of rape, but the judge said that being "from a good family" he did not deserve to be tried for rape, lowering the charge to abuse and considering that thanks to his " good family” the youth will have more opportunities if he is out of jail.

Despite the fact that in the same video the aggressor says "When your first time is a rape", the judge considered that the drunken state was the cause of the aggression and that his words were only to attract the attention of his friends.

Subsequently, the information that was delivered to the prosecution was that of a young woman vomiting, drunk, beaten on her buttocks and morally and socially violated.

The worst thing is that the young woman had decided to leave this episode in the past, but it was because GMC (name used to protect the perpetrator) continued to share the video, which led to the respective complaint.

However, this was not a reason for the Judge since he considered that there was no calculation, cruelty on his part, sophistication or predatory nature, by which the perpetrator acted to rape the young woman.

This sentence was quickly known by the New York Times, which was in charge of telling the story and asked the judge that the children of millionaire families also deserve to be judged.

As a result of the news, the case could pass in the following hours from a family court to a grand jury, where it would be treated as an adult and prosecuted for rape. After the publication in the New York Times, the judge has remained silent and although he is not an active judge (as he only covers occasional vacancies) he was asked to retract his decision.
