Former President Lula Da Silva of Brazil could be released due to constitutionality

Apparently, the legal part is under study on what the constitution says about the imprisonment of convicted persons in the second instance. Although the case has been under study for several weeks, some jurists assure that former president Luiz Inácio Lula da Silva, imprisoned since April 2018, should be released.

The Brazilian Bar Association (OAB), the Communist Party of Brazil (PCdoB) and the Patriota party were in charge of promoting this freedom on the constitutionality or not of the now imprisoned former president.

Its main legal object is the presumption of innocence, which prevents the execution of a sentence while there are still appeals in higher courts.

"The understanding that will emerge from here will serve as a guide for the performance of all the magistrates of the country and of the entire justice system. Let it be very clear that this trial does not refer to any particular situation" were the words of the president of the court.

Of course, this court ruling is drawing the attention of all the authorities in Brazil. Since the case of former president Luiz Inácio Lula da Silva is not the only one with this type of legal agreement and if they are released, another 5,000 prisoners would ask for their freedom.

However, the law firm assured that for this to be possible (release 5000 people) each case should be studied in particular. However, Lula has stated that his intention is to prove that he is completely innocent. The 73-year-old clings to the idea that his acting in government was entirely legitimate. Of course, he has stated that his intention is not to become president of Brazil again.

For now, he is serving a 12-year prison sentence.
