Spain considers it legal to pay debts with oral sex
It is not considered illegal, according to the constitutional court, to make payments to debts with oral sex. This decision caused great impact and confusion in the Spanish population.
The court decided that taking care of a debt contracted voluntarily with a fellatio to the lender, while facing the credited loan, does not establish an illicit and, consequently, it excused the appeal requested by the complainant.
The beginning of the debate originated in 2019, when a Mallorcan woman borrowed money from her ex-partner's brother, a total amount of 15,000 euros. According to agreements, she would pay in installments according to her availability.
According to the complaint, several days later, three days a week, she had to perform fellatio with the lender.
Both, in full agreement, met multiple times to have oral sex in the defendant's vehicle.
Although they had "an excellent relationship" until that moment, the woman admits that she feels threatened by her ex-brother-in-law.
The grievance reflects some threatening expressions, for example, that while the debt is in effect she will be taken as her personal prostitute.
“I am very radical. I can both be aggressive and vindictive. Are you aware of what I just told you? I don't have much pity the day I get into a combat plan. You should not question it”, the man declared.
The victim's legal advisers requested the initiation of a process for the crime of sexual abuse, while the investigating judge left him under serious duress, while the prosecution assumed that they were minors.
However, due to the consent of both parties, the Palma Court dismissed the case, prompting the complainant to file the unconstitutionality appeal.
